If you do not unconditionally consent to all covenants, operational limitations, intellectual property reservations, acceptable use guidelines, and dispute resolutions outlined herein, you are strictly prohibited from utilizing the Service and must immediately terminate your browsing session on phon.asia.

These Terms apply equally to all visitors, registered administrators, software evaluators, and content creators accessing Phon Voice Studio worldwide. Your engagement with any aspect of the audio manipulation tools signifies full capacity and legal authority to enter into this contract.

2. Permitted Uses and Architectural Functionality

Phon Voice Studio delivers browser-based digital signal processing (DSP), frequency transposition, pitch alteration, acoustic reverberation, robotic modulation, and audio synthesis utilities. All tools are offered for lawful entertainment, educational exploration, creative multimedia production, voiceover prototyping, artistic experimentation, and acoustic testing purposes.

The Service is offered free of charge for personal and non-commercial workflows, as well as commercial independent creator production, provided that such usage adheres rigorously to the Acceptable Conduct Standards described in Section 4.

You may utilize our audio toolset to modify your own voice recordings, create sound effects for indie video games, design podcasts, generate character dialogue for animations, and test vocal acoustics. Any commercial monetization of the final exported WAV audio remains exclusively your business, and we assert no claim to royalties or publishing percentages.

3. Intellectual Property Rights & Audio Ownership

Your Audio Assets: You retain complete, unconditional copyright, moral rights, and intellectual ownership over all original audio recordings, vocal stems, speech samples, and sound tracks that you input into phon.asia. Because all digital modulation algorithms execute locally inside your browser client, Phon Voice Studio never acquires any licensing rights, publishing privileges, or commercial claims over your modified sound files.

Platform Assets: All proprietary software code, HTML5 structures, CSS styling sheets, JavaScript DSP calculation engines, sound wave visualizer interfaces, SVG graphical elements, custom-designed icons, brand logos, and textual guides hosted on phon.asia are the exclusive intellectual property of Phon Voice Studio and its licensors. You may not decompile, reverse-engineer, redistribute, scrape, repackage, or clone the Platform's core codebases without our prior written authorization.

Nothing in these Terms grants you any right to utilize the trademarks, trade dress, or logos of Phon Voice Studio or phon.asia without our prior formal written authorization.

4. Prohibited Activities & Acceptable Conduct Charter

In utilizing Phon Voice Studio, you expressly agree that you will not engage in any of the following restricted behaviors:

• Unlawful Impersonation & Fraud: Utilizing voice modulation presets to deceive, defraud, or impersonate legal law enforcement, medical personnel, financial institutions, public officials, or private citizens without their explicit verifiable consent.
• Harassment & Malicious Communications: Generating, modulating, or disseminating audio recordings containing abusive language, hate speech, violent threats, racial slurs, defamatory attacks, or stalking behavior directed against any individual or demographic group.
• Non-Consensual Recording: Recording third parties without obtaining proper consent in accordance with applicable wiretapping, audio interception, and privacy regulations in your geographic jurisdiction.
• Deepfake & Synthetic Misinformation: Synthesizing misleading political propaganda, altered election soundbites, or manipulative media designed to subvert democratic processes or compromise public trust.
• Biometric Security Spoofing: Utilizing modulated audio tracks in an attempt to bypass, deceive, or penetrate telephone banking, electronic key fobs, or biometric voiceprint authentication systems.
• Automated Scraping & Platform Abuse: Deploying headless scripts, scraping bots, or network flood tools intended to disrupt server stability, compromise platform infrastructure, or extract site assets.

Violation of these conduct rules warrants instantaneous termination of access privileges, IP blocking, and, where appropriate, criminal referral to relevant law enforcement jurisdictions.

5. Disclaimer of Warranties ("As-Is" Provision)

THE SERVICE PROVIDED AT phon.asia IS OFFERED ON AN "AS-IS" AND "AS-AVAILABLE" FOUNDATION WITHOUT WARRANTIES OF ANY KIND, EITHER EXPLICIT OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE STATUTORY LAW, Phon Voice Studio DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACOUSTIC FIDELITY, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE AUDIO TOOLS WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR FULLY COMPATIBLE ACROSS EVERY BROWSER IMPLEMENTATION OF THE WEB AUDIO API. WE SHALL NOT BE LIABLE FOR ANY RECORDING GLITCHES, LOSS OF AUDIO WORKFLOW, DEVICE AUDIO HARDWARE MISCONFIGURATIONS, OR CLIENT-SIDE BUFFER OVERFLOWS.

Because hardware audio drivers, sample rate mismatches, and operating system permission sandboxes can introduce latency or audio clipping, users are advised to test microphone setups and export audio stems prior to critical production workflows.

6. Limitation of Liability

IN NO EVENT SHALL Phon Voice Studio, ITS DIRECTORS, DEVELOPERS, AFFILIATES, AGENTS, OR LICENSORS BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE DIGITAL SIGNAL PROCESSING TOOLS OFFERED ON phon.asia.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS ROOTED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL DOCTRINE, EVEN IF WE HAVE BEEN EXPRESSLY ADVISED OF THE POTENTIAL FOR SUCH DAMAGES. IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES IS RESTRICTED BY LAW, OUR CUMULATIVE LIABILITY SHALL BE STRICTLY LIMITED TO THE GREATEST EXTENT PERMITTED BY STATUTE, OR ONE HUNDRED US DOLLARS ($100.00 USD), WHICHEVER IS LESS.

7. Indemnification

You agree to defend, indemnify, and hold harmless Phon Voice Studio, its engineering contributors, officers, and service partners from and against any claims, damages, liabilities, costs, losses, and legal expenses (including reasonable attorney fees) arising from: (a) your breach of any covenant set forth in these Terms; (b) any sound recording or audio asset uploaded, processed, or exported by you; or (c) your violation of any third-party right, including intellectual property or privacy statutes.

This indemnity obligation survives any termination of your access to Phon Voice Studio and remains enforceable across all global jurisdictions.

8. Modifications to Terms and Platform Features

We maintain the unilateral prerogative to revise, amend, or supplement these Terms of Service at any time. Material revisions will be posted openly on this URL with an updated effective timestamp. Your ongoing utilization of Phon Voice Studio constitutes binding acceptance of all revised terms.

We additionally reserve the right to modify, replace, suspend, or discontinue any voice effect preset, algorithm, or audio processing tool at our sole discretion without advance notice or liability.

9. Governing Law, Dispute Resolution & Severability

These Terms shall be interpreted and enforced in accordance with the general principles of international commercial arbitration and electronic commerce law. Any controversy or claim arising out of or relating to these Terms or the breach thereof shall first be submitted to good-faith informal negotiations between the parties.

If any clause of these Terms is deemed unlawful or unenforceable by a tribunal of competent jurisdiction, that specific provision shall be deemed severable and shall not impair the validity or enforceability of any remaining provisions.

10. Copyright Protection & DMCA Safe Harbor Disclosures

Phon Voice Studio respects the intellectual property rights of musical artists, voice actors, sound engineers, and content creators globally. Because our digital signal processing architecture functions strictly as an interactive client-side tool operating locally within the user's browser, Phon Voice Studio does not maintain remote databases or user-generated media repositories.

If you believe that any graphical element, documentation, or code component hosted directly on phon.asia infringes upon your copyrighted work, please submit a formal DMCA notification to our designated agent containing: (a) physical or electronic signature of the copyright owner; (b) identification of the copyrighted work claimed to be infringed; (c) precise URL identification of the material; and (d) your full contact address and sworn statement of good faith.

11. Entire Agreement & Termination of Access

These Terms of Service, together with our Privacy Policy, Cookie Policy, and Voice Ethics Charter, constitute the sole and entire agreement between you and Phon Voice Studio regarding your access to and utilization of phon.asia. Any failure by us to enforce any right or provision of these Terms shall not be construed as a waiver of such rights.

We reserve the right, without prior notice or liability, to suspend, terminate, or restrict access to Phon Voice Studio for any user who engages in automated denial-of-service attacks, programmatic scraping, or attempts to exploit vulnerabilities in our server routing infrastructure.
